Re-Hiring Employees?
Below are three things to remember as your business re-opens or ramps back up over the coming weeks:
1. I-9: There is no need to complete a new I-9 form for re-hires. Only section 3 of the I-9 is required to be completed if the employee is re-hired within 3 years of the date when the I-9 was initially completed. (Section 3. see below at the bottom of the page)
2. PPP Loan Forgiveness: If an employee is refusing to return to work because she/he wants to continue to receive unemployment benefits, you will not be penalized for the headcount reduction on your PPP loan forgiveness. Please make sure you document your offer and the employee’s refusal. In addition, you may report this fradulent behavior to the Texas Workforce Commission.

3. Mandatory Poster: For businesses with 500 or less employees, make sure the Families First Coronavirus Response Act (FFCRA) mandatory poster is posted in your office’s common area. Email hannah.glasser@cubetalaw.com for poster.
